Disqualified office bearers & section 77

Hi,

Our Committee office bearers (Chairman and Secretary) is disqualified for 6 months from 28-Jul-26 under Section 75 and 82. After that the Committe lost the quorum. Out of sanctioned strength of 13 members, 10 members contested and got elected in 2023.

Out of 13 members, 3 members resigned in July 2025. the committee strength was reduced to 7 and in Jul 2026, the disqualificaiton of chairman and secretary further reduced to 5 member. In Short, they lost the quorum in July 2025 but kept continuting and after the disqualification order. they continue to hold office, sign notices, called election to co-opt the member to fill the quorum of 3 members, declared their status on notice board as "Active" despite being disqualifcation. Elections for co-opting these members were signed by Disqualified Chairman and Secretary. Manintenance bills were signed too by them.

All these matter were complained to the Deputy registrar but he is not taking any action. Proceedings of Section 77A also concluded on 16th Aug 2026, awaiting order currently at the time of writing this. On 4th Sep 2026, this disqualified secretary and chairman is calling AGM on 20-Sep-2026, despite having no quorum.

One of the Agenda item is Expulsion of members (no members specified, its obviously those who filed complaint that resulted in their disqualification). No procedure followed for Section 35. All this is reported to DR. We requested him to expedite on issing 77A order so that illegal AGM will not be conducted. We were told by the office that, "We will issue the 77A order only after 20th Sep 2026 AGM concludes". Needless to say the Deputy Registrar who is getting retired in December 2026 is managed and every lawless deed is happening in front of his eyes and he is letting it happen.

Kindly advise what needs to be done here?

The High court could be approached through an appropriate Writ.

The deputy registrar is not the final authority, in fact you can file an appeal against the Dy. registrar before the district registrar or approach the cooperative court for all relief and remedy in this regard.

We have filed a proceeding under Section 146 one month back, despite showing the urgency the Divisional Joint Registrar is not giving dates for hearing.

What happens when such disqualified office bearers and residual committee who does not have a quorum, goes ahead with the AGM. Will the resolution be null and void?
