Pl guide me if the police case can be registeredin the following case :
A flat was booked a flat in a pre-launch group housing scheme of. Builder informed us the they are agreement holderand developer of land.they also informed that they have entered into agreement of sale with original owners. believing their version (As doc proof shown was bulky and legal lang of agreement tricky) we booked a flat. however on delay on one pretext or another we enquired that builders didnt have the possession of land etc and survey nos and project not approved as such. now they are not refunding the money on one pretext or another . the director who entered into agreement has left the country. Chairman is there evasive all the time.
Legal notice for refund we are sending soon. However pl let me know
Can a criminal complaint be filed ? if yes on what grounds ( i m not legal person)..is cheating and breach of trust teneble ??
Also is agreement needs to be registered for criminal breach of trust ? As police said so .. their reason for not taking action.
