Interim maintnance amount

One of my friends Salary was around 90000 pm and tax was arnd 6500 , working below will help you to understand question better..

Gross Salary              P.M 90000

tax                             P.M  6500

Insurance burden         P.M 12000

Rent Payable to mother P.M 25000

House Hold Exp(food etc)P.M 20000

Disposable income(Balance left over)  P.M         26500

Now his wife has filed divorce case they have 2 kids namely 8 years and 6 years wife was working as freelancer earlier and average income per month was around 16000 , but now due to this episode he lost job and some how manage to get another job where he will get 50000 p.m gross because as per his current expenditure structure he will left out with maximum 12500 before household expense , now what all documents he need to submit to judge Salary Slip , last 3 month Bank statment etc will do.Judge Consider Past salary or grant as per present Salary

so now how much maintanance can his wife get??

You should let know the court.  Court will decide accordingly.  For 2 kids 15,000, for wife 10000 = 25000 per month might be ordered.  Wait till court orders, if you have any quams you can always approach appelate court.

You seem to have serious trust issues. In ur earlier posts u said ur friend's wife is going to file divorce and in this query u say she has already filed divorce. Also u seem to have indepth knowledge about ur friends life including break up of his salary. U r not trusting your lawyer , by this time u should have already chalked out ur strategy with ur lawyer to fight maintenance case. Dont take me wrong but if u do not act fast be ready for high maintenance order.

 

There is no need to disclose ur salary details ( earlier job) to court as it seems u (or ur friend) has changed job (90k to 50kpm) . Also it appears ur friends wife was working and earning 16kpm. Its responsibility of ur wife to prove ur salary in court. You should focus on producing her qualification /work exp. income details of wife to deny/ reduce maintenance claims. For kids u will have to bear their expenses.

 

Hire a lawyer at once and discuss with him in detail.  Can't comment more in absence of info.

Hello,

all thanks his wife was working as freelancer on consultancy basis and average income was around 16000 per month , second point she has produced some fake foreign university certificate post marriage with backdated it being issued (date was prior to their marriage), now if in cross examination if she is being asked about her education she might not show as B.SC but in such case producing her fraud B.Sc foriegn certificate help to reduce or no maintanance and If she accepts that is Fraud can that become negative that marriage was on grounds of Fraud information and how can that benefit can marriage in such case treated as Void???
