Impact of sec 9 on dv act

Decree of Sec 9 is in favour of husband.   It is well settled law that if there is decree of Sec 9 in favour of husband and wife has not complied such decree, she has no reasonable cause to leave her husband, and she can't claim maintenance in 125. On this ground her application under 125 has been rejected. Now wife has filed DV act.

                                  Is there similar case law that, in such situation she can't claim maintenance in DV act also. ?

What your lawyer say about this? According to me sec9 and 125 decision will help you in fighting case. DV can also be dismissed on time limitation bar if she file DV after one year of desertion.
