How good are family mous when dividing property?

Hi!

Ours is a joint family comprising 2 sons & a father.  There are fixed non movable assest  in name of our parents, which are being allocated in each sons name. However the process is lenghty & may take longer than expected.

As a precuationery I want to have an MOU amoung our family, so godforbid, just in case of my father death before proper allocation, we brothers dont get into any kind of dispute.

For some reasons his WILL may not hold good in our case. 

My query is : How good are these family mous? Can they be regstered? Can they be challanged in court?
