Housing society registered as firm

Our co-op Housing Society is in existence since more than 15 years. After that time we changed the chairman and the secretary. The official tax return could not be signed by any of the office bearers but only by the previous chairman. Checking the PAN card showed, that our society is registered as a firm. Is that possible and what are the consequences?

Dear Querist,

According to the Bombay High Court, a cooperative housing society can not be an "industry" as defined under Section 2(j) of the industry.

Hence, this is not possible.
