Gratuity - rare case

Dear Sir,

I am right now working in a public Sector company with wage scale of 1987.  Recently the management / Government came out with a VRS scheme with 2007 notational benefits for the optees.  My question is that

1. In the scheme of a notional VRS what gratuity act will be followed, since the employees are not going to be paid 2007 scale salary even once and till today all employees are drawing only wages based on 1987 scale of pay..

2. Is there any exemptions to the gratuity act which can allow calculation of gratuity on a pay scale (2007)which the employee has never seen and the wages of 2007 is only taken for calculation of VRS benefits and no actual wage slip is drawn for any one.

Kindly explain the situation and the legal implications that may arise.
