I worked with a pvt IT company from Dec 10, 2001 to Nov 22, 2006. I did not get gratuity payment as I was a few days short of 5 years.

I raised a query with my employer recently and got this reply. Should I pursue this further with them? Can I refer to any govt policy document which can help my case?
At that time as per policy gratuity is being paid to employees only after completing 5 years.
