Gift

Under Muslim law can an affidavit/declaration which is filed in a Suit in court actually be a valid declaration of a gift to a son living with his parents. He vaguely mentioned the gift in the affidavit. Is it a valid notice to other legal heirs who are not a party to the suit and being an unregistered document. Please any one help out with it. Declarant and his wife are both dead.

However, the property was jointly purchased (by the Declarant and his wife) with the money of only the Declarant (husband), the suit is filed in Mumbai and has now been withdrawan. Thereafter two children have filed a suit for their share in the eastate against other son claiming the property as a gift.
