Full & final dues

Hello Sir,

I have worked for a Pvt Ltd Company in Noida for 7 years. I have resigned from there on 01/10/2012 and served the full notice period of 30 days. My last working day was 31/10/2012. My company has paid my salary including for notice period on time but delaying my full and final (leave encashment & gratuity amount) of app. Rs 90000, also they are delaying my PF form as well. I came to know that the company has not paid any PF for this financial year. Moreover, this is the tendency of the company to delay the full & final of the employees.

Please suggest me the action I should take. I have already done few calls and follow-up on the e-mails as well but have not received any response on any of the e-mail.

What is your company a commercial or industrial establishment?

You should obtain documents e.g. acknowledgment of notice of resignation, acceptance of resignation, service/work experience certificate, relieving letter, correct FNF statement, Form 16 as per correct FNF statement, acknowledgment of company property/handing over the charge, PF number, PF a/c slips of entire period of your employment etc…by redg. post only..

Gratuity: Submit Form I to appointing authority/MD, under proper acknowledgment and demand payment, with a copy to controlling authority of gratuity under proper acknowledgment. Specimen is attached however you may obtain from company/controlling authority of gratuity which may be DLC in o/o Labor commissioner at your location. If company does not disburse submit representation to controlling authority.

Section: 7
Determination of the amount of gratuity

(1)

(2) As soon as gratuity becomes payable, the employer shall, whether an application referred to in sub-section (1) has been made or not, determine the amount of gratuity and give notice in writing to the person to whom the gratuity is payable and also to the controlling authority specifying the amount gratuity so determined.

(3)

It is felt that your employer has not issued and supplied any notice to you, and has not made the payment within 30 days.

 

PF:

Have you submitted forms PF withdrawal/transfer nad kept copies and do you have the acknowledgment and POD? Obtain POD.

Has the company issued any acknowledgment of PF forms?

Apply your resources and obtain acknowledgment even if by email.

The company should submit attested forms to concerned PF office within 5 days and supply the acknowledgment issued by PF office to employee by effective mode of communication e.g. redg/speed post.

You may submit a representation addressed to good offices of your appointing authority, MD, Chairman, Company Secretary and mention that you have submitted PF forms and these have been delivered on dated…..and POD is enclosed and acknowledgment issued by PF office should be supplied to you by redg. post and postage prepaid { as purchased from PO} self addressed envelope is enclosed herewith for sending the acknowledgment, payment of your dues by bank DD only, and all documents { whatever is pending} by redg. post so as to reach you in next 7 days.

If possible carry blank set of PF forms, cancelled cheque, visit the office with your witness and handover the covering letter, envelope etc in person and obtain acknowledgment with date under seal and signature of your letter and enclosures from reception where all mail of company is received and meet the concerned officials of the company and ensure that they have received your letter and enclosures from reception. If possible record {audio/visual}.

 Check the name of the company in the list of defaulters on the web site of EPFO:

www.epfindia.gov.in

You can obtain certified copies of Form 3A, 6A, 23, 24 thru RTI.

 

If the company does not supply the acknowledgment and a/c slips you can lodge complaint with EPFO.

You can also submit PF forms duly attested by BM of your bank direct to concerned PF office with a covering letter stating that company is not attesting your forms, submitting to PF office and is not supplying you the acknowledgment issued by PF office, and PF a/c slips of previous years..and RPFC should order inquiry by PF official in person and supply you the findings of the inquiry.

You can chase your complaint thru RTI.

If 7A proceedings are already initiated by PF office you can request to become intervener in the case and motivate other affected employees also to become intervener.

If PF office does not act properly you can pull them to Lok Adalat, DCDRF….

You can also approach o/o Labor commissioner and company may yield during conciliation proceedings.

FNF:

Obtain the copy of certified standing orders of the company {which should be displayed on notice board, near gate…and a certified copy should be supplied to employee against a nominal charge say rs.10/} HR policy, severance policy, FNF policy and demand that company supplies you a specific date by which payment by bank DD only shall be supplied to you thru redg. post only.

If standing orders are applicable to your company and have been extended to your designation company should have complied with the provisions and should have disbursed the payment to you on last day in office.

Model Standing Orders : 13{3},15,16,17

 

You can claim payment of wages under:

SE Act UP: 10, 11, 14, 18, 20…

Payment of Wages Act: 3{vi}, 5,13A,15, 16, 19, 20….

 

Claim interest for delayed period.

The company may yield to your representations or legal notice by your lawyer or you may have to agitate in appropriate forum.

You may contemplate to your due amounts as debt on company

Thank you very much for your response sir, my company is a commercial establishment. I have acknowledgment of notice of resignation, acceptance of resignation, relieving letter, & PF number. They provide the experience certificate, FNF statement, & Form 16 at the time of the F&F payment. As per the company policy I am supposed to receive all these after 45 days of last work day. But as I know, company is delaying F&Fs for months. In our company, employees themselves submit the PF form in PF office after filling it and get it signed from the company authority. I have submitted PF form in the company to get it signed two weeks ago but they are not giving it to me now because some of the PF forms have been rejected form the PF office due to non-submitting of the PF amount in the PF office for this financial year. I have sent them an e-mail stating that I have submitted my PF form to get it signed, please let me know when can I come to collect it and please also let me know the expected date of F&F payment; but I have received no response even after follow-up again in one week.

Should I still do some follow-up??

You have posted that:

As company has issued relieving letter it implies you have cleared whatever was due at your end and that is why you stand relieved.

 

--“They provide the experience certificate, FNF statement, & Form 16 at the time of the F&F payment.”

Do you have printout of the company policy mentioning 45 days for FNF settlement?

If 45 days are over you can cite the company’s policy and demand FNF statement and payment of FNF dues by bank DD only thru Redg. post only.

45 days are otherwise unreasonable.

If FNF statement is not correct you may decline to accept it and if payment is sent with FNF statement you may mention that FNF statement is not accepted and is rejected due to {mention details} and you have received payment by cheque/DD number….under protest.

In relieving letter if company has included your designation, location, period of service it shall suffice as service/work experience certificate.

 

Gratuity: Submit Form I to appointing authority/MD, under proper acknowledgment and demand payment, with a copy to controlling authority of gratuity under proper acknowledgment.

 

You may submit a representation by letter thru regd. Post addressed to good offices of your appointing authority, MD, Chairman, Company Secretary and mention that you have submitted PF forms and these have been delivered on dated…..to company and POD is enclosed and as per company’s practice company has been supplying attested copy of PF forms to employee for submission to PF office by employee.

However you have not received attested copies of PF forms despite many representations. If company has submitted PF forms to PF office the company has not supplied acknowledgment issued by PF office to you.

Hence attested copy of PF forms or acknowledgment issued by PF office should be supplied to you by redg. post only, along with correct FNF statement, DD for FNF dues, service/ work experience certificate, Form 16 as per correct FNF statement….{and any other document required by you} so as to reach within next 7 days. You may mention that postage prepaid { as purchased from PO} self addressed envelope is enclosed herewith for sending your payment and documents to you by redg. post.

If the company does not supply you the PF forms or acknowledgment issued by PF office you can submit the forms attested by BM of your bank to PF office under acknowledgment along with a covering letter addressed to APFC mentioning that company has neither supplied you attested copy of PF forms nor acknowledgment of submission of PF forms to PF office and copies of representation to company are enclosed, and request to take action and disburse PF amount to you.

 

If good offices also do not provide any relief then you can approach your lawyer {Your lawyer may opine that you fall within the category of workman},

 Inspector under SE Act, Payment of Wages Act, o/o Labor Commissioner, or civil court as advised by your lawyer and as deemed at your end.

Thanks again for your valuable response. I do not have company policy in return. Also now they have replied that they will reply to me by Feb end.  I think I’ll be requiring someone to assist me on how to get things done. Can you please suggest someone in Noida?

--APFC in O/o PF commissioner

--Controlling Authority for Gratuity which may be DLC in O/o Labor Commissioner at your location. (Before that you may submit FormI under acknowledgment to employer).
