There are three clusters in our complex. Each cluster has three wings. Builder has completed two clusters as on date.

All three wings of the first cluster has received Occupation Certificate. Builder has initiated the process of society formation for the first cluster.

However, the complex of three clusters has many ammenities such as cricket ground, club house, and a variety of other ammenities which is not complete in totality.

The maintenance of the common area shall be with the builder till such time all the three clusters are complete. The foresight of common ammenities shall be 5 years from now.

Queries:

1. Number of societies to be formed in the complex to take complete hand over of all ammenities from builder. We have heard minimum five societies is required. Builder is planning to form one society per cluster i.e. three societies. Is three society format is feasible option to take complete handover.

2. We have to pay maintenance charges to builder for common area maintenance till the time he completes the entire project. The project is already delayed for more than 3 years as of now. Can the builder be penalized to do the maintenance of the common area till he handovers the project in totality.

3. The society is responsible to collect CAM charges from residents to pay to the builder for common area maintenance. What if few residents do not agree to pay common area maintenance to the society.

Apparently, the housing society in India should be formally registered with the Registrar of Co-operatives whereas every city in India must have its own rules regarding the housing society. Every building located in same premises must have a separate or single society. Most of the basic housing societies in India are formed in one federation. Whereas every housing society may run based on the charges or fees rated by the flat owners. Nevertheless, some of the basic housing societies composition in India are rich in cash.
