Extra maintenance charges from rented flats

Hi there, I own a flat in pune, which is given on rent. Monthly maintenance charge is Rs.2000/- for self occupied, and Rs.2500/- for rented flats. When I asked Society about the rule of max 10% NOC charge for rented flats, they said we are taking 10% only from rented flats. and Rs. 300/- more for using amenities (These charges are approved/passed in AGM). As per my opinion, these extra charges are unfair and illegal (Ref -https://www.lawyersclubindia.com/articles/Non-Occupancy-Charges-in-a-Society-5705.asp) . I want to send notice to the society for the same and if required want to appeal in consumer court/Sub registrar. Need your guidance on the same.

IN case of intended litigation;

Relate your matter with LOCAL bye laws/Model Bye Laws/Act and precedence’s/judgments

If you are properly informed PIP and well versed with procedures of Forum/tribunal/Court then go ahead

 

Or lean on your own very able LOCAL senior counsel of unshakable repute and integrity specializing in consumer/society matters and well versed with LOCAL applicable rules/laws and having successful track record…. and worth his/her salt..

Inquire about such counsels at LOCAL consumer Forum/tribunal/Courts……….
