I would to seek advise from anyone who could help with regards to property/land owned in Palakkad. Before the demise of my grandmother, my mother (who resides in Malaysia) and her sister (residing in Singapore) were given a piece of land with a property erected on it. The land was said to be divided into 10 shares ie. my mother and her four children (5 shares) her sister and her three children (4 shares) and one share under my grandmother which is said to be entitled to all her eight children as she did not leave a will .
After the death of my grandmother, the house on the said land was occupied by her brother, my uncle who then reconstructed the house with financial help from my mother. He has since occupied the property until his death in 2013 without rental. The house now is occupied by his son. The son has his own piece of land inherited from his father which is just next to this subject land.
My mother, who has been visiting India regularly has requested him to vacate the land/house as we feel that he is more than capable of constructing his own home on his land. Is there any possible way of getting him to leave the property or claiming our rights of the 5 shares. Please advise
