I had filed for divorce U/s 27 SMA-1954. It is already more than One and Half year that my wife has not submitted the counter to my petition. But she just filed a petition for Interim Allimony and then submitted an application for squashing my petition. The case was not squashed, but Interim Allimony was granted for her withou hearing and counter. Now I have challanged the IA order in High Court. But in lower court, her advocate is arguing that she will not submit the counter as she has not received the IA.
Should she be allowed by court to take time to submit the counter?
How can I convince my advocate to get the counter? OR, shall I wait till the IA decided by High Court?
