Ep for partition suit while case is at high court appeal stage

Also I have filed EP at district court. Kindly advice whether the same get proceeded or stating that the case is on appeal at high court and will be put on hold.

If there is no stay from hc then ep will proceed further.

Dear Sirs, I have applied for EP through lawyer, but the Clerk does not register or stating he has to check with the Judge before registering as there is an appeal. Is it legal to keep it pending by the Clerk. Kindly advice.
