Election candidate under msc act

A member of Housing society sub-letting his flat s and staying in same society on leave and licence qualifies as candidate for election to Managing committee.

Refer bye laws of society or seek from Registrar of societies about qualifications and disqualification for members for election to Managing committee as per norms.

As a owner of a flat he is entitled to participate in the elections of the association.

He is a genuine member of the association since he has bought the flat by a registered sale deed, hence he cannot be denied or deprived his rights.

Prima facie it is a hypothetical story.

Why does a member stay in the same society on lease & licence and rent out his own flat?

However, as a member he has all rights.

Why has this done like this is his freedom to anything with his flat, but this fact is true in my society. If he still has a to contest in election, then it is acceptable. I had a doubt in such case hence raised the query.
