Respected members...this is rajendra from bangalore....my bro got married in 2011 at bidar.....after tat she came to our parents residence at bangalore...after sometime she started quarreling with my bro to make seperate house....when my bro refused to her demands....she desserted him in  2012..... she went to her parents house ...my bro made every efforts to bring her back....he went to bidar to take her back...he sent a letter by registered post...in turn she lodged a complaint in women cell....women cell summoned my bro and her wife...she made false allegations against my bro...after detailed discussions she was advised to return to matrimonial house.

Be informed, women like these are not fit for matrimonial home, they are better of alone,

...after having agreed she refused to come to bangalore....

IF she had refused to come back to matrimoniial home at bangalore, your brother should have sent a legal notice to that effect to return back to matrimonial home.

after tat we filed RCR in family court bangalore....she in turn replied with false domestic violence case against my whole family in which she made false allegations of dowry harresment and she claims that she spent huge money abt 8lacs for marriage..

Now this was bound to happen, your brother I dont know which idiotic lawyer he consulted, before filing for RCR, he should have sent a notice through a lawyer to come back and join him in the matrimonial home, as I said above, . And later on filed RCR, and subsequently after when she is called for concillation where she would have agreed to the fact that she does not want to come back to matrimonial home, could have subsequently filed for divorce on basis of wife deserting husband.

she is saying we have given physical torture...she has recorded audio conversation...she inturn complaint higher authority of police for not resgistering FIR...on the phone call through mediator she demanded 25 lakh compensation...I KNOW MOST OF THE LAWYERS WONT SUGGEST GOOD ADVICE TO HUSBAND....in fact our lawyer is saying go for settlement....how can we go settlement...my bro is earning salary of 6500/month...

Sorry to say this it is a mamool thing for women to file a case in DV and make false accusations. Demanding money is also mamool case...

and more sorry to say this that if brother was earing 6.5K per month, marriage is a costly issue in terms of not getting along with each other.

If your brothers lawyer is telling go for settlement, it is the best option available, manage to pay somehow to pay money, not whatever she asks but how much your brother can pay to her, if not there is another form of settlement, ask your brother to bow down before her, and that everything forth wil be according to her wishes, and he will do whatever his wife wishes, and settle down with her.!!

.are we earning in lakhs?? this has become modern menace in family courts..

.she is intrested in money...she took her mothers advice irrespective of right or wrong...couple are having one female child     

TELL YOUR BROTHER'S WIFE AS SHE WILL BE YOUR BHABHI.

Not all get the opportunity to have a family, there are many a couple who dont have kids, many a parted couple who long to have kids and lead a happy marital life, ask her to adjust somehow, forget the ego, eat the egg, as egg good for health, not ego. Ask her to join your brother to lead a happy  marital life for the sake of the kid, who is a girl child, looking for a prospective customer even if divorce takes place, will lead to more complications such as

1.  Custody.

2.  Maintenance of wife and kid.

3.  Visitation rights.

4.  Husband may end up not paying alimony, come what may, so again doing rounds to courts.

5.  All in all waste of precious time and money.

QUESTIONS

1.most of them are saying rcr is useless..really?? she is not attending rcr  (3 hearings over) she is not accepting summons

RCR is useless, as no court can force any spouse to cohabit.

2.how much time does it take to complete dv case..my bro  has to travel from b'lore to bidar which is around 700kms to her native place

Yes the distance wont become less from Bidar to Bangalore unless your brother shifts to Bangalore.  The DV case will get over in 3-4 year's time at the earliest, given warrant, exparte orders, going to set aside of orders, she filing rejoinder to main application, examination chief [both], cross examination [ both ], arguments, further arguments, then one day order, if it comes in favor of wife, husband go for set aside, if it goes in favor of husband, wife can go for set aside... 

3. we have appealed for stay for interim maintainance dv case...will stay be granted ??if stay granted are there any chances of cancelling stay??

If you elaborate on the above question I would be able to give a better answer!

4.she has eye on my fathers property...she want to keep my bro as center and demand money fom my father......how to get rid of this??

5.she is highly qualified...in past she has worked in google and as taecher...presently she is working as teacher in private school...how do i get details abt this??

Highly qualified?  Get her educational qualification detalis, marks card, etc, if she is well qualified, high court will set aside her alimony/maintenance plea, as she is well qualified.

You follow her bank account, and can get details via RTI, rest can approach directly to the school she is working and ask for records, if all this is not possible, can ask court to get details, but for that you have to submit address where she is working, which school etc

6.i want to know more abt RCR...how much time does it take to get judgement...if it goes expartee...can she appeal?? 
 

RCR is waste of time, even if she gets RCR judgment in favor of her, its of no use, if husband will not take her back.

7.how to get her PAN card no?? in dv case she has claimed tat my bro is drawing salary of more than 30,000

It is up to the husband to give details as to she is capable of earning money

9.how to proceed with divorce?? she is not staying with my bro nor giving divorce

NOTE :-MY BRO'S WIFE DOSENT HAVE FATHER...THATS WHERE WE HAVE DONE GREAT MISTAKE AND NOW WE ARE REGRETTING IT...SHE ALWAYS TOOK HER MOTHERS ADVICE IRRESPECTIVE OF RIGHT OR WRONG
 

Make wife understand, her mom there not permanently, she will kick bucket anytime, but it is upto her brains to know what is good for her future, father already passed away, if she keep listening to mom, as mom already feeling lonely, would want daughter to join her and kill her loneliness. But there is no issue from the marriage [no kids] so why the hell is the mother hell bent to retain her daughter?  Ask her mother to let her go off, and that she will keep visiting her when possible.

Mothers like this are home breakers.  They tutor daughters so that they leave their household and join her, which is of no use.
