Disposal of cmp in main(dv) petition

Is it essential that CMP(discharge) in a main(DV) petition to be disposed first before proceeding in main(DV) petition in a JM court?

Provsions of CrPC are not applicable in a DV proceeding. The opposite party is not  an accused, but only the respondent? As such, in my understanding.  a discharge petition may not be maintainable.
