Disgruntled Employee creating problem

Dear Forum,

    I am HR head in a small firm in Coimbatore, one employee recently resigned and we slapped notice period clause even though it was unfair on our part. The employee in question left company as he was not confirmed after 6 months of probation. But for relieving letter we unethically took three months salary.

   The employee by protesting finally paid up , but after this he has made very bad derogatory remarks on company and key individuals on consumer/product website by name www.mouthshut.com , this is affecting our business and public image though we accept our mistake.

   How to deal with the situation, please help, Does legal case against him work  ? How much time it will take to take action on employee ? Will it work out fast ? We are ready to return the extra  money we have taken from him while severance.

Please Advice some  workable solution

Adding to the above post, we have NO absolute evidence that the same employee has done it, but we are only sure he is the one as he was unjustly treated in recent past....

You are served well. Nogotiate with him if you have no evidence as you claimed. Even if you have evidence still you ar ethe loser it matters little whether you beat the mud or mid beats you. Mud is never going to be dirty.
