Defective phone

Actually for the first time I have used online shopping site Tradus.com and ordered one Samsung S Duos through it in March'2013 of Rs. 12,800/-.  The phone has not completed its 1 year ans started showing there problems.

Firstly they cheated me by sending the Black color phone inspite of my order for White piece. Then they have not send the earphone to me.  Upon inquiring they said the pkt doesn't contain the earphone.  Its from the company side only.

Upon Discussion and calls to the distributor I got the earphone but the defective one.  Still I managed and buy a new earphone but now the phone is having the problem that its not charging and has not completed its warranty period.

I showed the same at Samsung Authorised Centre but they told me that this phone can't be rectified here as it is an imported one and doesn't have Indian Softwares.

I called up the distributor and Tradus Team but didn't get any response from them.  Kindly advise me what action I can take against both of them.

Don’t buy from online portals.

The discounts which look attractive are flasshed to allure the unsuspecting citizens and consumers.

Try by approaching consumer help groups like:

The Samsung may come forward to replace the phone.

Or

You may have to approach consumer forum.

It shall be appropriate to show all docs and record to a lawyer specializing in consumer cases.

Thanks for your response Sir.  In fact I have stopped using these online site for purchasing anything.  But the product I already purchased is now becoming a big headache for me.

Thanks for your guidance. Any other thing that I can say to the dealers so that they came into pressure and replace the same.
