Declared value in the registered sale deed.

Dear All,

Can the declared sale value(consideration) in a registered sale deed be less than the Jantri?

Eg. if the Jantri is 17 lacs, can the consideration paid for such a house property be 5 lacs in the registered sale deed?

Is there some new law which doesnt allow this?

If a lower  consideration than the jantri is shown  in the sale deed , would there be any Income tax problems for the buying party and the selling party ?

Jantri is only for determination of the stamp duty. The declaration of the sale value has to be actual amount paid as consideration. It could be less or more since this is a part of the agreement between the buyer and seller. However, care must be taken that the payments are through cheque/DD and the true value declared.

I heard there is some new law introduced which doesnt allow the sale value(consideration) to be less than the jantri value .

No new law is introduced. In income tax rules , the income tax dept. can purchase the said property at that lower price. then put to auction. because of poor response to the IT auctions it is not inforced by ITD

So does it mean that is it legal for the Agreement signed between the sellor and buyer to have a higher value than the value for which the property is registered?

For example, if a piece if land is sold for 30 lakhs, but registered only for 15 lakhs?
