Criminal breach of trust

A lends to B under a loan agreement for B's daughter's education purpose where B's son is witness. However, B is not repaying loan back and B's family i.e. herself and her husband are harassing A when talking about loan repayment since B's daughter got a good job now. Further, when seeing bank account of B it is seen that not all amount of loan is utilised for B's daughter's education as B spent for other purpose also. So A is thinking of filing FIR for criminal breach of trust against B and her daughter. What other actions can she take against B's husband and her son. Please mention sections of IPC if possible.

Contact a local advocate as you require detailed brief on the issue.  First focus on receiving the money.  The contract is between A & B and you can proceed against B only if you have not claimed any interest and if the loan is documented legally.

No criminal action lies. Of course, you have the option to seek civil remedies.

No criminal breach of trust. You can only file civil suit.
