Court marriage process

Hello, I am Anmol. My partner and I, both Hindus, had our marriage performed by a priest in a temple according to Hindu rituals, including exchanging garlands and taking the Saptapadi (seven steps around the sacred fire). A few of our friends attended as witnesses, but no family members were present. Could you tell me that can a marriage performed by a priest in a temple be legally registered, and what is the process under the Hindu Marriage Act, 1955? What steps must Anmol and Rina follow to register their marriage?

Hello Anmol. This is the process according to my knowledge. You may get a second opinion on thee same before you move.

  • so first of all, see that the requirements given below are fulfilled:

  1. Groom must be 21 years and above
  2.  Bride must be 18 years or above
  3. Neither person should already be married
  4. They should not be in a close blood relationship.

 

 

  • These are rituals that you must get performed by the priest in order to give sanctity to the process of your marriage:
  1. where  the wedding starts with the Havan, a holy fire ritual where prayers are offered for blessings.
  2.  then the couple then does the Saptapadi,walking seven steps around the fire .
  3. They finish by exchanging garlands in the (Jaimala).

 

  • After these rituals the marriage is considered religiously valid.

    Then see that you have the given documents in to prove your marriage before the resgistrar:

  1. Marriage photographs
  2. Wedding invitation card (if available)
  3. Certificate from Priest (Pandit)
  4. Photo of rituals (Likel: Saptapadi)

 

  • Now apply for the court marriage registration where the husband and wife submit a joint application to the marriage registrar in court.
  • Then see that you have the given documents for marriage registration .
  1. Identity proof (Aadhaar Card)
  2. Age proof
  3. Marriage photographs
  4. Passport size photographs
  5. Witnesses ID Proof

 

  • Now couple must appear in the registrar office with 2 or 3 witnesses. Witnesses confirm that the marriage actually took place and both parties married with free consent.
  • Now the registrar checks and verify the all documents, identity proof and marriage details and other documents. If everything is correct the registrar approves the registration.

 

  •  Now the last step is that you get marriage certificate issued and the marriage is recorded in the official marriage register. The couple receives a marriage certificate.

Yes, Anmol and Rina's temple marriage can be legally registered under the Hindu Marriage Act, 1955 (HMA), as it involved essential Hindu rites like garland exchange and Saptapadi, witnessed by friends.

This solemnization per Section 7 of the HMA makes the marriage valid for registration under Section 8, even without family present, provided proof exists. 

 Registration, while not always mandatory nationwide, is recommended (and compulsory in some states per Supreme Court guidelines) for legal proof in matters like passports or inheritance.

Registration ValidityA priest-performed temple marriage qualifies if key ceremonies (Saptapadi, etc.) occurred, as confirmed by sources on Hindu law. 

 Friends as witnesses suffice, and a registered priest's certificate strengthens the case.

Steps for Anmol and RinaFollow these at the Sub-Registrar Office (SRO) in Hyderabad/Telangana where the marriage occurred or they reside:Download/fill Form A (HMA application) in duplicate; both sign it.

Gather documents: wedding photos (showing couple), invitation card (if any), temple/priest certificate, age proofs (SSC/passport/birth certificate), address proofs (Aadhaar/Voter ID), 3 witnesses' details/IDs.

Submit at SRO with both spouses and 3 witnesses present for verification; pay fee (around Rs. 100-200).

Attend scheduled appointment for signing; certificate issued shortly after (often same/next day if no issues).

Yes the marriage can be reegistered , however for other requirements you may apoproach the local marriage registgrar and comply them to enable the registration of the marriage
