Most of the courts are practicing that at the time of filing petition for succession certificate (it is required to get pension entitlement) only Rs.1.25 (one rupee and twenty paise) court fee stamp has to be affixed. Once, the court allows the prayer for succession certificate, 2.5% of the value of the amount claimed to be deposited in the court in the shape of court fee. But in the case of pension, that amount cannot be calculated. In my opinion, court fee at the rate of 2.5% on the amount, which he can claim in 12 months has to be paid. (I am ready to get corrected if I am wrong).
