Court Fee

Greetings to all,

I have filed a suit for bare injunction. My prayer in the suit is for perpetual injunction against the defendant from interfering with plaintiffs possession and enjoyment. I have calculated the ad- velorem court fee of Rs.10000/- and court fee paid under Sec.26(c) Andhra Pradesh Court Fee and Suit Valuation Act. Plaintiff is the owner of all the properties shown in plaint. There are around 12 survey numbers. The office of the court has taken objection that as there are different survey numbers I have to value the suit for 10,000/- for each survey number and pay court fee separately for 12 survey numbers. I understand court has discretion to direct plaintiff to enhance the valuation from 10,000 to some other amount. But my doubt is whether it is necessary to pay court fee separately. Pls clarify with some citations.

Regards..
Jeevan
