Contract labour

Suppose the contractor failes to pay wages to the workers and also did not pay p.f. and e.s.i., then the principal employer should have to pay the wages to the workers as well as pf. and esi. In such a case, the ratio which is to be payable by the workers can be deducted from their wages.

In case the wages were already paid by the contractor but not the pf and esi and in such circumstances the principal employer has to pay pf and esi, then how to deduct the workers share if that is not deducted by the contracotr at the time of payment of wages!!!!!????  In such situations, should the contractor has to bear the whole amount on this account????
