'relieving letter will be required to prove my past experience or email from My Supervisor will be required in that email working tenure should be mentioned f=date of joining and date of relieving.'

 

Relieving letter signifies that: Employer has separated (say by resignation/termination) and nothing is due against employee.

 

Copy of notice/final resignation, Acknowledgment and acceptance of resignation, correct FnF statement, Form16 as per correct FnF statement, PF a/c statements of each year,ESIC Card,handover of charge,NOC/NDC, salary slips of all months, handover of charge. etc etc..........................should suffice to establsih DOJ,LWD. 

 

You can certainly get email from Supervisor.

You must care for the feedback.

So much so that you must get the copy of BGV from next employer.

Draft a gentle communication addressed to good offices of appointing authority, CEO/MD (India) and other stakeholders that you would deem fit to keep in loop…………………….and narrate date on which you tendered notice of resignation, notice period…………………days…………….and LWD dated;…………………….in accordance with  clause………………..in appointment letter dated………………..issued to you………………

 

And request to supply the docs e.g; Copy of notice/final resignation, Acknowledgment and acceptance of resignation, correct FnF statement, Form16 as per correct FnF statement, PF a/c statements of each year,ESIC Card,handover of charge,NOC/NDC, salary slips of all months, handover of charge. etc etc..........................within and upto LWD i.e. dated;……………………..

 

Highlight the achievements, commendations, awards, rewards, incentives, contributions etc etc………..and copy is attached( e.g; as in appraisal, and attach a copy).

 

 

 

 

Mention that never ever any stinker, show cause notice was issued to you.

 

Don’t forget to add that NO tasks are pending at your end and routine duties be assigned that can be completed on day to day basis within and upto LWD dated;……………………….and to whom you should handover the charge within and upto LWD dated  of course under proper acknowledgment. This may include: DOJ/LWD, designation, nature of duties, tasks, KRA’s etc etc )

 

 

 

Narrate the representations made and meetings with female HR person during which she disclosed that after your notice of resignation notice period has been changed from back date ( explain how) and if changed notice period is not served it would leave to ‘Job Abandonment’………………….

 

Clarify that you are separating by proper notice as applicable to you and are not abandoning /absenting/absconding, at all and no such remark declaring you as abandoning /absenting/absconding be inserted in company’s records (your personnel files/service card.)

 

You may request that in service certificate/relieving letter issued to you, all commendations about you may be narrated ( e.g; as in appraisal).

 

 

If the need be you may request to allow to let you examine your personnel file.

Take help of elders in the family, well wishers to draft if required.

Don't lave any loopholes in the hands of HR,employer as these may bother you later.

The Mangemen'ts unilateral change of notice period at the time o f quitting to  2 months is  highly arbitray, illegasl , highhanded and unconstitutional and needs to be set right. By filing a Petition in Labor court you challenge your casse on the above contentions after issuing a due Legal Notice to Managemnt.. Try to settle amicably. In case they don't comeround file Labour court case.,If you appreciate this reply please click the thank you button on this forum.
