case laws on Special Allowance following subject

Dear Friends,

we are paying spl.allowance to our workers as per govt.notification in july 07,that spl.allow.has come down from 939/- to 549/-now in jan.09 it is declered Rs.873/-we are paying Rs.939/-as spl.allow.some company they have adjusted the diffr.in Basic ,our workers are demanding diffr.between Rs.939/- and Rs.549/- as fixed da.

can they demand it because we have not reduce it.we have maintain it as it is..and

The minimum wages has two components.

1 Basic wages 2.special allowance.

As long as the total wages paid to the workmen do not fall below the aggregate of the

components mentioned above,you are on complying with Minimum Wages.As far as demand is concerned,that is the question of collective bargaining,not involving legal issue.
