Buying land from second owner of sc / st land alloted govt

Hello experts,

 

I am Arun from Bangalore.

 

I am planning to purchase a plot in Bangalore , Bannerghatta road.

 

That particular plot was allotted by government through HUDCO to the SC/ST for free in the year 1980 with lock in period of 20 years for resale.

 

In the year 2001 that particular property was sold to another SC/ST person who is the current owner of the freehold property.

I belong to general category and interested in buying same plot from the second owner (SC/ST who bought it in the year 2001). The property documents are clear and there is no litigations / issues pending against this property.

Can you please share opinion on if I purchase a plot from second owner, will that property sale will be valid and there will NOT be any violation of Karnataka state transfer of property laws.

This is with limited understanding on the matter. Kindly check with  a local lawyer dealing in such/revenue matters and well versed with local laws.

IN such cases usually prior permission from Collector is reqd. The award documents may be pursued.

You may obtain a reply preferably thru RTI on both points:

1.        The land can be resold after 20Y or not?

2.        The sale deed to current buyer shall be valid or not?
