Builder absconding can i take possession?

Hi,

Need some advice. Many of you must have read about South Goa under construction property that collapsed which was by Bharat Developers. I have an apartment in one of their other projects in South Goa, which was due possession Dec`13 but due to some final work they shifted the possession to Jan`14. Now due to the building collapse the builder is absconding.

Points to be considered: -

  • I have paid 20% to the builder and remaining is bank loan from SBI which is already release to builder
  • I already have an agreement document with 1% stamp duty paid to the government which is which SBI
  • I don’t have possession letter
  • On my last visit I found that property is ready except some minor work is left which I can take care

Please advise me on following:

  1. How long should I wait for builder to return or respond?
  2. How can I take possession of my flat?
  3. Under such forceful possession (if applicable) how do I apply for water & electricity connection?

Thanks,
