He presented one of the cheques in his bank. The cheque bounced. Your bank is refusing to give you a xerox copy of the cheque. Now if your bank has returned the cheque, how can the bank give you a fascimile of it? The cheque would have been returned to the money lender's bank and, in turn, the money lender's bank would have returned the cheque to the money lender himself. Has the money lender sent you notice under Section 138? If so you can say that you were not aware of the issue of the cheque and ask the money lender for a fascimile of the cheque. If he refuses and files complaint before a court, he will have to attach fascimile of the cheque to the complaint. You will receive the fascimile from the court along with the notice.
