I got hit by 498a along with my younger brother and Parents. My younger brother granted AB and regular bail under 438 ( 2) and he travel to abroad for work. His quashing petition for 498a is stayed at High court until disposal of case.
Today there was hearing at District court regarding violation of bail and opposite party insisting the court to impound his passport. My lawyer stated that case is stayed at High court even District Judge stating to opposite party lawyer that since case is stayed at High court he don't have any power to take any action.
Opposite party lawyer stating that there is provision in law that District court can order to impound passport even case is stayed at High Court....
Please guide me whether District court can take any action even if case is stayed at High court??? Any provision there in law for doing such action?
