attestation form regarding

sir, I have selected for a government job. I have some queries regarding filling up
attestation form. My elder brother got married and divorced. My name was also included in DVC and 498 case. Now the matter was settled and the case was disposed. We are aquitted then. now I
have few queries regarding filling up of Attestation form.

1) what option should I select for "Have you ever been prosecuted" ? ( We were not arrested)

2) What all the documents should be attached along with attestation form ? whether the divorce documents of my brother also should be attached?

I perceived from your query that you and your brother were suspected for your brother’s Divorce case due to domestic violence and cruelty under Section 498 of IPC.

You were involved in the legal proceedings of your brother’s divorce which means prosecution, so the answer to your first question "Have you ever been prosecuted"? is “YES”.

Also, you were not convicted i.e. you were not declared guilty of any criminal offence by the court or arrested for that matter, so if asked "Have you ever been convicted"? the answer is “NO”

In common parlance, the following list of documents are to be attached:

  1. Identity proof
  2. Address proof
  3. Educational credentials
  4. Work Experience proof

Also, there is no need to attach divorce related documents until asked for.
