Association of management level staff

I am working in a private limited company. Recently company handed over discontinuation of service letter along with one month salary extra to some of the staff due to low business activities in the company.

Letter and cheque handed over to them and informed them not to report on duty with immediate affect.

As a result, all other staff of management grade decided to form an association with support of external union keeping in the mind of there turn of disassociation from the company purely due job insecurity feelings.

Please advise as to whether such association will be legal or illegal as per the prevailing labour laws of our country.

Thank you

Regards

You have posted that:

"As a result, all other staff of management grade decided to form an association with support of external union keeping"

Apparently you know or have assumed that you don't fall within the purview of ID Act/Workman.

White-collar workers unions are registered either under the Trade Unions Act, 1926, or under the Societies Registration Act, 1860, and are known as employees unions, or employees or staff associations.

There is no illegality in forming union as long as they comply with the provisions of the Trade Union Act.

Registartion under Tarde Union Act is recommended.
