PRIYA SHETTY (ASSISTANT MANAGER - ACCOUNTS)     18 August 2014

Allegedly Sale of SRA property

Dear Experts,

Our father's commercial property in Mulund, Mumbai has been redeveloped in 2005 under SRA Scheme by a well known Builder. Our father passed away on 19/09/11 leaving behind our mother & we 3 sisters as his legal heirs. Later we learnt that the possession of the said property has been given to someone else as the said premises has been sold before the redevolopment. The fact states that my father had availed a loan of Rs 2 Lacs from his cousin, who is now the Treasurer of the Society formed after redevolopment of the said premises. Society people & Builder, no one are supporting us.

We therefore approached SRA & accordingly in a hearing called by SRA, Society people produced General Power of Attorney, Sale Deed & Affidavit (none of the documents are registered) & only notarized (which does not contain before me) in which it is mentioned that the paid amount of Rs. 2 Lacs is against purchase of the said property. We denied as we are pretty confident that our father has never sold the said premises & the signatures on the documents are not signed by him. SRA has sent their decision on the hearing held stating that the said premises still belongs to our father and asked us to go to Court if we need to prove that the signatures are not of our father.

Now what action do we need to take. Kindly advice.
