A PERSON WHO SAYS THAT LAND BELONGS TO HIM - D
[1] That A is owner and valid title holder of agriculture land area 1.13 acres any pays revenue to state govt. and also paying irrigation tax to state govt. that A land is in village x.
[2] That a lotory is conducted by person B . that c is licensing authority . that c is collector and district excise office.
[3] That lotory auction was conducted for year 2015-2016 .for selling liquor in village x.
[4] that C becomes highest bidder for retail english liquor shop in the village x.
[5] that B provide licence to c.
[6] that C does tresspass to land of A. and construct the shop. make temporary road in the agriculture land of A.
[7] That A get knowlegde of C activity and does complaint to excise officer B on 10/04/2015. and demands to stop the selling of liquor from his land.
[8] That no action is done from the officer B. and no reply to Letter of A IS GIVEN.
[8A] That C and D MAKES forged agreement of rent on the above land.
[9] That as per excise law and rules is that a shop is to be situated in no objection place. as per law violation of that law and rules is voileted.
[10] That land is situated in between two national highways.
[11] that as per rule made in excise law of state location of shop does voilation of law. that shop is 101 meter from 0ne highway but is 74 meter from other highway.
[12] that land owner filles a writ petition in hc to displace the shop from his land.
[13] that after 5 months order is passed by HC to demarcate the land by B IN PRESENCE OF A and C. and odrer that B will decide the matter after representation made by A and C .
[14] that demarcation was done as per hc odrer founded out report that shop is build in the land of A. and 74 meters from national highway.
[15] that after demarcation A AND C PRESENTED HIS REPRESENTATION .that B PASSES AN order to remove the shop OFC.
[16] NOW IT IS CLEAR HEAR THAT STATE WAS INVOLVED IN THE SELLING OF LIQUOR FROM THAT SHOP. TAKEN NO ACTION IN THE ABOBE MATTER . AND BOTH B and C COMBINDLY DONE DAMAGE TO A.
[17] THAT STATE { B } TAKES 2.5 CRORE RUPEES AS LICENSEE FEE FOR ONE YEAR .
[18] THAT C AND D MAKE FORGED RENT AGREEMENT WHICH SHOW THAT 35000 RENT TO BE GIVEN TO D.
[19] NOW ITS POINT
