High court

T. Kalaiselvan, Advocate (Advocate)     10 June 2021

The trial court can dispose the bail application filed before it praying for regular bail by  the person held judicial custody.

As per your concerns!

Section 306 in The Indian Penal Code(IPC), 1860 prescribes Abetment of suicide; If any person commits suicide, whoever abets the commission of such suicide, shall be punished with imprisonment of either descripttion for a term which may extend to ten years, and shall also be liable to fine.

Section 306 of IPC, 1860 is falling under chapters XVI. However, as per the said section, it is a Non-bailable offence.

The regular bail is discussed under sections 437 and 439 of the Criminal Procedure Code, 1973 (CrPC), when bail may be taken in case of a non-bailable offence and special powers of the High Court or Court of Sessions regarding bail respectively.

Henceforth, Section 306 and 34 under Indian penal court triable by court of session.

Hope it clarifies the issues!
