  • vikas says : agricultural and distribution
In 1968 my father bought 2.06 acre land( in chhattisgarh) in the name of me(radheshyam ) and my elder brother(daya). At that time we were not adults. That land is in hands of my father since last 45 years. Now my father wants to distribute this land in his 6 son and 4 daughter because they were not born that time but i dont want to distribute that land.My all brother and sisters have applied a case in tehsildar court to distribute this land. my questions are as follows: Qu 1: Is there any possibility of distribution of this land to all the brothers and sisters? Qu 2: Is there any necessary steps to be taken by us and our lawyer to regain control over that land?

  • Deep Inder Grewal says : Regarding Will of the deceased
Dear Sir, My grandfather who passed away last year has 4 chidren - 2 sons (one my father and his elder brother)and 2 daughters (my fathers elder sisters). In 2003 my grandfather made a registered will(with witnesses), clearly stating that all his properties (self acquired)agricultural and commercial (giving complete adress of the properties)and his bank accounts should be divided equally amongst both his sons. He said that he is very happy with the look after of both his sons. He also stated that whatever money he wanted to give his daughters he has already given in their marriages. Now the problem is that one of the daughters, i.e. my fathers eldest sister has sent summons from court to the rest of the siblings challenging the will and stating that the will is fake and that it was she who looked after my grandfather. My questions are:- 1. Can this will be challenged in the court? 2. Can she claim 1/4 (one fourth) of the entire wealth of my grandfather? Your advice will be highly appreciated.
