  • EccentricallyMad says : 138 Non Negiotable Instruments Act
Hi, It would be nice if you could advise me on the following. I had taken a loan in the year 1999 from a Co-Op bank. I never gave the any cheques are guarantees. In the year 2005 I gave them 3 cheques which the bank stated they bounced which never reflected on my bank account. Later they said they were lost. All 3 cheques were dated and in the amt. of 3500 each. Now after 7 yrs they have approached the police and issued a bailable warrant on my name. They never sent me any notice in 2005 as per Section 138 NI act. I had paid the principal amuount of 70000 of the 1 lakh I had borrowed. I failed to pay the rest balance since 2005 and now the matter is in the civil court since 2009. Are they allowed to issue a arrest warrant against me after 7 yrs of the supposedly cheque bounce? Please advise me Thanks
