  • durgesh says : gift or sale deed
Hi, I have taken a flat on my wife's name.(Registration done only on my wife name). But we have taken a home loan on both the name(hasband - borrower and wife - co-borrower). My wife is a house wife. And I am paying full EMI of our home loan from my salary account. Now i would like to get the IT benefit under section 24 (B) of Income Tax (Repayment of home loan), but my employer says they need proof of ownership of property and IT certificate from Bank to avail the benefit. In this case I have produced IT certificate from Bank which has both the name (hasband - borrower and wife - co-borrower). And Index-II(registration) which contains only my wife name. Hence I have 2 questions 1. Should I really have my name also in Index-II(registration) to avail the benefit? if yes, 2. Can I do it through gift deed ? if yes, can I do it 10% on my name(husband) and remaning(90%) on my wife name. I am ready to pay stamp duty and registration charges as applicable. Please suggest.

  • kaushal ramesh says : seller not agreed to sell land as per agreement
Sir I wanted to buy 1361x2=2722 Sq.Ft land in Patna. Seller has sold backside 1361Sq.ft & at the same time, Made an Non registered Agreement (on Rs 100 Stamp paper) for the front side land of 1361 Sq.ft to buyer. In that agreement it was mentioned that buyer had paid Rs 1Lakh for land and rest had to pay within 2months 15days deadline. After two weeks of agreement buyer went to seller house for paying remaining money(in cash as he demanded). He took away cash and agreement paper & went inside. After all if and buts, he hadrefused to sell land to buyer and began to abuse before so many people. Even he refused to return back the agreement paper. After people pressure he gave the agreement paper but edited it so many places & signed that is clearly visible. Buyer Advocate had sent a notice to seller 15 days before, but he didn't answer. What should I do? He is even not ready to return whole amount(Rs nine lakhs). He is agreed to return only One lakh which is written in Agreement paper. Witness (who have also signed on agreement paper)are ready to say the fact That strenghten my position. Sir what will happen if this matter goes to court for jurisdiction?

  • Praveen says : stridhan
My mother's mother is the only daughter of her parents. My grandmother has two daughters i.e my mom and my aunt. My grandmother inherited the property from her father and she has gifted it to my aunt's son without our consent. What right shall we have over the property? My grandmother says it is stridhan but it is ancestral property. How to go about in fighting for our legal share in the property. Please give your valuable suggestions.
