Submissision of proofs beyond date

Guest (Querist) 15 October 2013 This query is : Resolved
Respected Adv,

I had 3 dates consecutively say 10, 11 and 12. Judge asked us on 10 to submit all proofs by 11. I was unable to submit single proof on 11 but submit few proofs on 12. Now I want to submit rest of the proofs which are approximately 70 pages.
I moved application for 1 week time on 11. Then again moved application for time on 12 also.
Will I allowed to submit my proofs.

Premature query.
Let the judge pass order first.

Devajyoti Berman Sir , I don't understand your reply "order" . I am very much stressed that will I be allowed to submit my rest of the proofs.

depends on discretion of court.
Dr J C Vashista (Expert) 16 October 2013
Althoough discretionary but judiciously and can be challanged if denied
prabhakar singh (Expert) 16 October 2013
It's all procedural and lies with in discretion of court and courts generally lean towards allowing such application with compensatory cost payable to opposite side.
Devajyoti Barman (Expert) 16 October 2013
That is why it is said let he judge pass order first.
Whether you would be allowed or not, the court has not decided yet.
For rests, other experts have already advised.
