Credit card dispute with standard chartered bank

(Querist) 15 October 2013 This query is : Resolved
Dear Experts,

I had disputed a fraud transaction on my SC credit card in Feb-2013. The transaction was some 19,000 russian ruble (INR 34,000). When i submitted the dispute form i was informaed that investigation will take 45-90 days and i will receive formal communication. As i was living abroad since Jan-2013, i had updated the customer care both via email and over phone that i need all communication on my email and my postal address is no longer valid. For next 6 months i did not receive any communication from them. I contacted them again in July-2013 and then they said that they have completed the investigation in favor of the merchant and sent the transaction details to my mail address. I asked them to provide me the transaction details, details of the merchant, proof of purchase on my email, but they have not provided it till today. I have been calling them and writing email on a regular basis but they do not provide any specific answer. All they say is that it was a secured online transaction and i must pay immediately.
So now my question is -
1)What will happen next? How long can they stretch the case? What about the high intertest that they have adding all this time?
2)Do i have the right to demand proof of purchase and other transaction details from the bank? Since I do not have any information about the merchant, i cannot communicate with him.
3)Since i had clearly updated them about my living abroad status and my desire to receive all communications via email at the start of the dispute investigation. Is it my fault that i did not receive the document which they sent to my postal address?

Iy appears that the credit card had been issued in India. The queriest can approach the consumer disputes redressal forum.

The banker has failed to discharge its duty as per your version and now the only remedy available with you is to file either a consumer complaint or a complaint before the Permanent Lok Adalat for pblic utility services of your native area.

Yes, go to consumer forum and agitate your dispute.
Let it adjudicate all the disputes between you two.

The Bank can not proceed further for payment for the transaction along with interest if it is not a position to produce the merchant transaction slip with your signature. Immediately you write back to the bank that unless the slip is provided to you, you are not going to pay this amount and interest on it as you have not utilized the card for the said transaction. Later you can take the recourse as suggested by the experts above.

As I am abroad now on a company assignment, is it possible to file a case in consumer court online? The credit card was issued from the Mumbai branch of the bank.
Devajyoti Barman (Expert) 15 October 2013
No you ca not. You can engage an advocate and fight the case from abroad.
You can execute a POA in favor of your family members to put signatures on your behalf.

Till you send the POA in favor of your family member, ask your lawyer to send legal notice on your behalf. send soft copies of all the correspondence and documents material in the matter.

1)They shall have to mend themselves. If they are turning deaf ,file consumer complaint, they are at fault, and can not claim any principal then why to think of interest.

2)Yeah! You do have such right.

3)NO! It would not be construed as your fault at all.
Rajendra K Goyal (Expert) 21 October 2013
Well advised, nothing more to add.
