women share in father`s property

Can women take her share in her father`s Property??????

Property is come from by grand father.

 father & Mother both are died.

One son & one Daughter only.

Daughter is married before 1984. But the her brother transfer the property into his name with out permission of sister.

 

At present can she calim her share or not???

 

Pls give suggestions

When the father died? Date of marriage of a girl is immaterial. Being a co-parcener female has got equal rights in the ancestral property.

As regards ancestral property daughter is equally entitled  to a share in it as son of co-parcenery after the amendment Act which came inot force in 2005(Hindu SuccessionAmendment Act.2005. This will be applicable only to partitions or deemed partitions that effected after coming into force of the Amendment Act.

      As far as the State of Tamil Nadu is concerned , married women who were married before the Hindu Succession (Tamil Nadu)amendment Act came into force in the year 1989 are not entitled for a share in the ancestral property as a member of the coparcenery.
