Waqf activity

Hello everyone. On our land, a few years ago, around 25 people were living as tenants in small 200-square-foot houses that we had given them. One room there was empty, and they started offering namaz in that room. After some time, we found out that they created a trust for that room and started calling it a masjid. Now they want to declare that room and the surrounding area as Waqf property. They even began doing charity work using my father’s name without our permission, even though the property card is still in our name. Can they make the land Waqf just by doing religious activities there?

You can request the Commissioner of the Wakf Board authorities whether your land is under the Wakf Board or not and the Market Value from the Sub Registrar concerned.  If your land is noted as wakf land, the SR gives you it is a prohibited land or the market value of your land.

This is the reason that the latest reformation was introduced by Central government in the name of an amendment to the wakf board act.

You may have to fight it out through civil court for now because the act is yet to be enforced.

Sounds like you're dealing with a tricky situation. Simply offering namaz or doing religious activities doesn't automatically make the land Waqf property.

The Waqf Act, 1995, has specific provisions for declaring a property as Waqf, and it typically requires a formal declaration and registration. Since the property card is in your name, you have a strong case.
