Urgent please reply if possible

Sir this is urgent, please reply if possible 

My ews certificate was rejected by concerned tehsildar. 

•  income is below 8 LPA
•  agri land is below limit 
•  no residential flat 
•  no non muncipal land above limit 


Tehsidar rejected stating you “possess” 180 sq yard house in muncipality 

Sir ,the said land ( 180 sq yard ) is already acquired by government for irrigation project ( award and compensation paid ) and all rights including ownership is vested with state .

But concerned tehsildar stated you still live in that house  built on government land hence you  “possess “ it .

Sir is his rejection justified , i hope someone helps me

You have option to approach the High Court in a Writ Petition.

You first file an appeal with all documents before the District collector, if the reply is not in your favor,  you can file a writ petition against Tehsildar before high court for relief and remedy.

Tehsildar must have found some records pertaining to your property before rejection of your application, which you have attempted to conceal.

What is your annual income from all sources?  You exceeded the area of 100 square yards in a Municipality.  You can appeal to the District Collector with a copy of the letter/notice issued by the irrigation department.

Facts

     ( not a single thing has been concealed by me  - all other conditions are already met . I had declared all this under sworn affidavit to authorities ) 

- that land was purchased by us in 2006 via registered mutation 

- in 2018 we built house

- 2025 , we sought Fard of this land to sell because we wanted to shift back to  ancestral village ( under limit already )

- Fard rejected - reason ( already permanently acquired by irrigation department ) ( patwari , Naib tehsildar, zilladar , executive engineer rejected - i have all reports and replies) 

  Found out we were scammed , person name X who sold land to us in 2006 sold the same
Land to government in 1976 

- our sale and mutation has been called invalid by revenue departments 

X name was in award and compensation lists provided to us by irrigation departments 

- if we would have sold the land , then eventually had gotten ews , but now we are stuck . We can’t sell , mutate , collateral , inherit and may he evicted as the project is still under process as per official reports ( can't even Claim adverse posession )  . The patwari said it is permanently acquired for Gair mumkin Nahar .


Sir I just want a clear reply it is worth pushing for ews . Family income is  4 lakhs from all sources . 



village ancestral  is under limit ( i will apply there as i am a permanent resident of village ) and the said property is in a different Tehsil . 

 

am I even eligible . Is it worth pursing . Do i even have a compelling case ?

Title (ownership) of the land do change / trasfer by mutation. Accordingly it is an eye-wash.

Multiple issues are involved in the facts vis-a-vis queries, it would be better to consult a local prudent lawyer with relevant records for proper analyses of facts / documents and professional advise

Thank you for your responses. 
 
However, my current question pertains to EWS eligibility . Weather the said property will be counted as my family's asset ?
 
For land issue we will definitely seek legal advice
