I recently got my new house done and got this notice from one of my contractor relating to dues to him through one of the trade unions in Delhi.
Following points i want to highlight:
1. Avdesh kumar, as mentioned in the attached notice was not my direct contractor. I gave my contract to Surendra kumar, who I think further given this contract to him. But, I dont have any written communication or contract.
2. Rates mentioned in this letter are very inflated and we gave contract at very less price than mentioned in this letter. Again, no written contract. But, I have a xerox a final calculation sheet which he handed over to me in which rate and measurements are mentioned. But on a plain piece of paper with no signatures but has a date 17 July 2013.
3. We did not utter a single word like he is mentioning in his letter. He did not complete his work satisfactorily, so we withheld certain amount, around 30,000 and he never came to complete his job.
4. He is threatening through this letter that he will bring people and all which may cause defamation.
5. All payments made to him, are accepted by this contractor, Avdesh kumar on behalf of Surendra Kumar and signed in our payment diary.
Please go through the letter and guide me to draft a reply to him which will prevent any further proceedings and settlement.
