Urban land ceiling act

I am Gopalakrishnan from Coimbatore Tamilnadu
I have purchased a residential plot on 2000 and registered with department In 2001
I completed the residential construction works followed by all legal regulations in 2004 I was informed that the surrounded areas of my residence was held by the government under
URBAN LAND CEILING ACT but at the time of registration nothing was mentioned in EC and the plan is approved by DTCP which self declared itself after then we have given several petitions to all related officials even to collector and chief minister but nothing happened despite we also informed to the department to remit the fees under RDO'S MS GO issued in 2008 results nothing in 2015 we formed an association and filled a writ petition before honorable Madras High court in October 2022 the court pronounced judgement in our favour
but the department response with silence after 439 days the government filled appeal despite the appeal period is declared only 90 days
now i totally upset i can't understand
what can be done to reform my plot hence I request hereby to advise me The department officials personally said me to withdraw the case or come out from the case
i couldn't understand this statement the appeal to set aside the order is filed by the government then
How can I withdraw kindly advise me in this matter

Consult your lawyer who is well aware about facts and circumstances of the case and has been sailing you through and through.

Now that the Writ Appeal is filed, you need to await the decsion. Delay in filing an appeal is condonable if sufficient cause is shown.

What You Can Do File Objection: Through your lawyer, submit a strong objection to the government’s condonation petition, highlighting the 439-day delay.

Maintain Your Rights: Do not withdraw — withdrawal would mean voluntarily giving up the favorable judgment.

Seek Execution: If the appeal is dismissed, you can move for execution of the High Court’s order to regularize your plot.

 Association Support: Since you filed as an association, continue collective representation — this strengthens your case.

Do not budge to the departmental pressure and do not withdraw the cases, you may contest the appeal as per the procedures of law thorugh your advocate, don't take any hasty step to ruin your future in this regard
