To pay back the advance amt

I had given my property in jd to a construction company. Mou was done and mou lapse period was mentioned 9 months. In mou regarding fundable and non refundable amount was mentioned in that they paid me very little amount. Rest of the amount and agreement has not been made till date. Now i want to give my property to others since the mou period has been lapsed. I want to know if i have to return the amount.
