Time limit before concluding deficiency in service

Respected Lawyers,

I bought a product online directly from the company. It comes with 2 years warranty. Within months it developed issue. I showed video evidence to the company.

Company has taken it back for inspection.

Now it’s nearly a month gone but they are not responding. I want to serve a formal notice to refund or replace the product now stating that this delay this constitutes defciency in service.

How long should I wait before sending the notice. Is there any defined timeline in consumer law?

Thank you sir.

I think I was not clear with my question. I am not asking what time frame I should give in the  notice.

The question is how long should I wait after the product is taken back by company before sending a notice to them.

I am trying to get in touch with them thru emails, WA but they are not responding.

So does the consumer protection law state any such duration to wait before concluding that there's confimred deficiency in service?

Generally one month time is sufficient to move to the jurisdictional Consumer Disputes Redressal Commission but within 2 years of purchase of the product.

There's no time limit to wait for the company to accede to your request in this regard.

You may wait for reasonable time and then proceed legally against the company.

Two years time limit is fixed  from the date of cause of action accrued to file consumer complaint before Consumer Commission  but no time limit is fixed to replace defective product or to solve your problem. You needn't to wait more and  move.Issue notice immediately and demand replacement of product or refund price with cost.

You can file complaint in consumer court within 2 years from the date of purchase of product .

Dear Client,

While taking the product from you for inspection is there mentioned any time frame to complet the issue please check in Inward Invoice, if not mentioned in the Inward Invoice one month is reasonably time, that too you already you did sent mail till did not receive reply from them.

You can issue formal notice by mentioning 10 or 15 days time or through an Advocate

If there is no reply from them you can proceed legally in the District Conumer Dispute Redressal Commission
