Need Advise,
One of my freind obtain legally Marriage Certificate only for US visa process. (he has having h1b visa ) but there was no engagement or marriage.further my friend decided not to marry with said girl, bcoz of cheating, and certain unacceptable demand. Now my freind has made an application in the court for cancellation of marraige certificate.
pls. advise , what will be the status of my freind after cancellation of marraige certificate. ie whether divorsee or anything else.

under wich section has he filed the said application ?

The suit is not maintainable because suit cannot be filed for cancellation of marriage certificate. Either he has to file divorce

Thanks Mr. Rajeev, i also discuss the case with my friend, who is a judge, he has also given same openion. that he has to file divorse case.
